Welcome to CherryBalmz.com (the “Site”), owned and operated by CherryBalmz Weapons Lubricants, LLC  “CherryBalmz,” “we,” “our,” or “us”), a Nevada limited liability company.

By accessing, browsing, or using this Site or purchasing our products, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use (“Terms”) and our [Privacy Policy]. If you do not agree, do not use the Site.

 

  1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under applicable law to use this Site or purchase our products. By ordering, you represent and warrant that you meet these requirements and that your purchase and use comply with all applicable local, state, and federal laws.

 

  1. Product Use Disclaimer

CherryBalmz products are designed exclusively for lawful cleaning, lubrication, and maintenance of firearms.

  • We do not sell firearms, ammunition, or any items regulated under the Gun Control Act (GCA) or National Firearms Act (NFA).
  • Our products do not enhance lethality, convert functions, or modify weapons in a legally restricted manner.
  • You are solely responsible for compliance with all local, state, and federal laws applicable to the purchase, possession, and use of firearm-related products.

Firearm Use Risk Acknowledgment
 You acknowledge that firearms are inherently dangerous and that improper maintenance, including misuse of lubricants, can result in mechanical failure, personal injury, or death. CherryBalmz is not liable for misuse or improper application of its products.

Export Compliance
 You agree not to export or re-export our products in violation of U.S. export control laws, including the Export Administration Regulations (EAR) and, if applicable, the International Traffic in Arms Regulations (ITAR).

 

  1. Orders, Payment & Fulfillment

All purchases made through the Site are subject to product availability and our acceptance. We reserve the right to cancel or limit any order at our sole discretion.

  • Prices are listed in U.S. Dollars and are subject to change without notice.
  • All applicable taxes and shipping fees will be added at checkout.
  • Risk of loss transfers to you upon our delivery of the order to the carrier.

 

  1. Shipping Restrictions

We currently ship only within the United States. Some states or jurisdictions may restrict certain types of firearm-related products or content.

State Restrictions
 You are responsible for understanding and complying with your jurisdiction’s laws regarding the receipt and use of firearm-related maintenance products.

We reserve the right to cancel or restrict orders shipped to jurisdictions where our products may be prohibited or restricted.

 

  1. Returns and Refunds – All Sales Final

All sales made on CherryBalmz.com are final. We do not offer returns, refunds, or exchanges under any circumstances unless required by applicable law.

Products are sold “as-is, where-is,” with no warranties or guarantees, express or implied.

This policy applies regardless of:

  • Ordering Errors
  • Misapplication or improper use
  • Dissatisfaction
  • Shipping delays or damage caused by carriers

By completing your purchase, you acknowledge and agree that:

  • You have read and understood our Return & Refund Policy, which is incorporated by reference into these Terms.
  • You waive any right to return, refund, or exchange unless the item arrives in a materially defective condition and is reported within 72 hours (see below).

Defective or Damaged Shipments

If an item arrives materially defective or damaged, you must contact CustomerCare@cherrybalmz.com within 72 hours of delivery with photo evidence. Claims received after this window will not be considered.

Refunds or replacements for damaged items are issued only at our sole discretion, and submission of a damage claim does not guarantee a refund.

 

  1. No Warranties; Disclaimer of Liability

 TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHERRYBALMZ PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Limitation of Liability
 IN NO EVENT SHALL CHERRYBALMZ OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR MISUSE OF ITS PRODUCTS OR THIS SITE.

Our total liability shall not exceed the purchase price you paid for the product giving rise to the claim.

 

  1. User Content

If you post or submit reviews, testimonials, or other content on or through the Site, you grant CherryBalmz a non-exclusive, royalty-free, perpetual license to use, reproduce, publish, and distribute such content.

You represent that your submissions:

  • Are accurate and not misleading;
  • Do not violate the rights of any third party;
  • Do not include prohibited, obscene, or defamatory material.

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

You agree that any disputes shall be resolved exclusively in the state or federal courts of Lyon County, Nevada.

 Nothing in these Terms limits your rights under the consumer protection laws of the state where you reside, if those laws apply and cannot be waived by contract.

 

  1. Dispute Resolution – Arbitration and Class Action Waiver

To resolve any disputes in the most cost-effective and efficient manner:

Binding Arbitration
 You agree that any dispute, claim, or controversy arising out of or relating to your use of the Site or purchase of our products will be resolved exclusively through final and binding arbitration, administered by a mutually agreed-upon provider, and conducted in Lyon County, Nevada.

Class Action Waiver
 You agree to resolve disputes with us only on an individual basis, and not as a plaintiff or class member in any purported class, consolidated, or representative action.
